Terms of Service — DiscreteStack Inference API

DiscreteStack AD · api.discretestack.eu
Last updated: 27 October 2026 · Version 1.0

These Terms of Service (these "Terms") describe the terms and conditions under which DiscreteStack AD ("DiscreteStack", "we", "our", "us") provides access to the DiscreteStack inference API available at api.discretestack.eu, together with related software, documentation, and services (collectively, the "Services"). By accessing or using the Services — or by clicking a button or checking a box marked "I agree" (or similar) — you agree to be bound by these Terms. If you use the Services on behalf of an organisation, you confirm that you are authorised to bind that organisation. If you do not agree, you must not use the Services. Where you have entered into a separate written agreement with us (such as an Order), that agreement prevails over these Terms to the extent of any conflict.

1. The Services

1.1 We provide hosted inference on open-weight models. The models available are listed in the API catalog and are currently organised into Compact and Max classes. The Services accept text and image inputs and generate text outputs through /chat/completions, /responses, and /messages-compatible interfaces, with streaming and non-streaming responses.

1.2 Model listings include per-model information such as pricing, context length, maximum output tokens, supported features, and data centre locations. The Services are operated in the EU.

1.3 Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable right to access and use the Services for your business purposes, to build and operate your own applications and services on them, and to distribute them as permitted in section 4.

1.4 The Services may be provided under an Order or other written agreement, on a metered usage basis, or through third-party platforms; the fees applicable to you are described in section 5. We may select, update, and replace models, features, and infrastructure from time to time to maintain or improve the Services while keeping capabilities and backward compatibility; material changes are handled under section 14.

2. Eligibility and Your Responsibilities

2.1 The Services are offered for business and professional use. You must be at least 18 years old, capable of entering into a binding contract, and not barred from using the Services under applicable law.

2.2 Access is provided through accounts and API keys. You are responsible for your users, applications, credentials, and everything done under your account. Safeguard your API keys, do not share them outside their intended scope, and promptly notify us of any suspected compromise at technical.support@discretestack.com.

2.3 You must comply with applicable laws in your use of the Services, and you must have the rights and lawful basis necessary to submit your inputs and to use the outputs. You are responsible for assessing outputs before relying on or distributing them.

3. Your Content

3.1 "Content" means the inputs you submit to the Services and the outputs generated. You retain your rights in your inputs, and we claim no ownership of Content.

3.2 You grant us a non-exclusive, worldwide licence to process Content solely as necessary to provide the Services to you, in accordance with these Terms, our Privacy & Data Policy, and (for customers) the Data Processing Agreement.

3.3 Subject to applicable law and third-party rights, you may use outputs for any lawful purpose, including commercial purposes. Outputs may be inaccurate, non-unique, or subject to third-party rights; we do not guarantee accuracy, suitability, exclusivity, or non-infringement, and you are responsible for how you use and distribute them.

4. Restrictions and Acceptable Use

4.1 You may integrate the Services into your own applications and services, make them available to your own users and customers, resell and distribute access through authorised platforms (such as marketplaces and routing platforms, including OpenRouter), and charge your users for your products and services built on the Services.

4.2 You must not (and must not permit or enable any third party to):

4.3 If you distribute access to the Services, you are responsible for your customers' use and must bind them to terms at least as protective as these Terms, including this section 4. We may suspend access for violations, as described in section 10.

5. Fees and Payment

5.1 Fees. In addition to any fees set out in an applicable Order or service order, you will pay all fees charged to your account as agreed in writing or published in the API catalog (collectively, "Fees"). Depending on how you access the Services:

5.2 All Fees are exclusive of taxes, levies, and governmental charges, which you pay separately, except taxes on our income. You will provide complete and accurate billing information.

5.3 Amounts due are payable as agreed in writing or published in the API catalog. Undisputed amounts that remain unpaid may incur statutory late-payment interest and result in suspension under section 10. Fees paid are non-refundable except as expressly stated in these Terms, your Order, or applicable law. We may add or amend Fees prospectively, subject to section 14.

6. Intellectual Property

6.1 We and our licensors retain all rights in the Services, including our platform, software, inference runtime, and the models we operate, together with all related intellectual property. No rights are granted except as expressly stated in these Terms.

6.2 If you provide feedback or suggestions, you grant us a licence to use them without restriction or compensation.

6.3 Section 3.1 governs ownership of Content. "DiscreteStack" and our logos are our trademarks; you may not use them except as permitted by law or with prior written consent.

7. Confidentiality

7.1 Each party will protect the other's non-public information with reasonable care, use it only in connection with the Services, and disclose it only to personnel or advisers who need it and are bound by confidentiality. Exceptions apply to information that is public without breach, was lawfully known or received, or is independently developed. Compelled disclosure is limited to what law requires, with notice where lawful.

7.2 These obligations continue for three years after termination, and for trade secrets for as long as they remain protected under applicable law.

8. Privacy and Data Security

8.1 We process personal data as described in our Privacy & Data Policy (https://api.discretestack.eu/api-privacy-policy) and, for customers, the Data Processing Agreement. In summary: inputs and outputs are processed only to deliver inference and are never logged or written to persistent storage; request metadata (which never includes Content) is retained for no more than 90 days; neither Content nor metadata is ever used for model training; and all processing takes place in the EU.

8.2 We maintain technical and organisational measures appropriate to the risks under Article 32 GDPR, including authenticated access restricted to authorised personnel, encryption, request isolation, and operational monitoring without Content logging. We maintain ISO/IEC 27001, ISO 9001, and ISO/IEC 42001 certifications; a SOC 2 Type 2 report is available on request under confidentiality.

9. Service Levels and Support

9.1 We design the Services for high availability and operate towards a target of at least 99% availability per calendar month. Where your Order, or the platform listing through which you access the Services, states specific service levels, those apply to that access.

9.2 Support is provided by email at technical.support@discretestack.com during EU business hours (09:00–17:00 Europe/Sofia, Monday to Friday, excluding Bulgarian public holidays). We aim to provide an initial substantive response by the end of the next working day. This is a response deadline, not a guaranteed resolution time.

10. Term, Suspension, and Termination

10.1 These Terms apply for as long as you access or use the Services. If your access is provided under an Order or through a platform, termination of that access is governed by the applicable agreement or the platform's terms.

10.2 We may suspend access immediately where reasonably necessary to address unlawful use, a material security threat, or a legal requirement, giving notice whenever practicable and restoring access promptly once the reason is resolved. For direct accounts, we may also suspend access if an undisputed amount remains unpaid 10 calendar days after written notice. Fees continue during a justified suspension caused by you.

10.3 Either party may terminate for a material breach that remains uncured after written notice — 10 calendar days for a payment breach, 30 calendar days for another remediable breach.

10.4 On termination: fees accrued through the termination date remain payable; unused prepaid amounts are refunded promptly, less undisputed amounts owed, except as otherwise stated in your Order or applicable terms; access ends. Provisions intended to survive — including confidentiality, ownership, accrued payment obligations, liability, and general provisions — continue.

11. Warranties and Disclaimers

11.1 We will exercise reasonable professional care and comply with applicable law. Beyond our express commitments, and to the extent permitted by law, the Services are provided "as is" and "as available", and we disclaim warranties of merchantability, fitness for a particular purpose, uninterrupted or error-free operation, and non-infringement.

11.2 We do not warrant that outputs will be accurate, complete, current, unique, or suitable for your purposes. You are responsible for reviewing outputs before relying on them. Nothing in these Terms limits mandatory rights under applicable law.

12. Indemnification

12.1 You will defend and reimburse us, our affiliates, personnel, and suppliers for third-party claims, damages, and reasonable defence costs arising from your Content, your use or distribution of the Services, your customers' or users' conduct, or your breach of these Terms, except to the extent attributable to our intentional misconduct or gross negligence.

12.2 We will promptly notify you of such claims and reasonably cooperate at your cost. You control the defence; settlements imposing obligations or admissions on us require our consent.

13. Limitation of Liability

13.1 To the extent permitted by law, our aggregate liability relating to the Services is limited to the Fees paid by you for the Services in the six months preceding the event underlying the claim.

13.2 We are not liable for indirect or consequential losses, lost profits, revenue, or opportunities, loss of goodwill, or replacement-service costs. Expressly owed fee adjustments and refunds remain payable.

13.3 These limits do not apply to intentional misconduct, gross negligence, or liability that cannot lawfully be limited. Nothing in these Terms limits mandatory rights under applicable law.

14. Changes to the Services and Terms

14.1 We may update the Services — including the API catalog, models, features, and infrastructure — prospectively, to maintain or improve them.

14.2 We may also update these Terms. Material changes require at least 30 days' notice by email or through the Services, with the updated text or a link, the effective date, and identification of the affected terms. Changes cannot alter accrued rights or charges already incurred. Continued use after the effective date constitutes acceptance; if you do not agree, you must stop using the Services (and where an Order applies, you may terminate per that agreement).

15. Governing Law and Disputes

15.1 Bulgarian law governs these Terms, with exclusive jurisdiction in the competent courts of Sofia, Bulgaria. Where your access is provided under a separate agreement or through a platform, that agreement's or platform's dispute provisions apply to that access. Nothing in these Terms limits mandatory rights under applicable law.

16. General Terms

16.1 Precedence. If you have entered into a separate written agreement with us governing your use of the Services (such as an Order), that agreement prevails over these Terms to the extent of any conflict.

16.2 Third-party platforms. The Services may be made available through third-party platforms such as OpenRouter. Third-party platforms are independent businesses; their terms and policies apply to your use of the platform, and we are not responsible for their services, terms, or billing.

16.3 Miscellaneous. If a provision is held invalid, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or transfer of assets. These Terms, together with any applicable agreement, the pricing and payment terms described in section 5, and the Privacy & Data Policy, form the entire agreement between us regarding the Services and supersede prior understandings on that subject. Notices to us go to legal@discretestack.com; notices to you go to the email address associated with your account. Electronic acceptance and communication are permitted.
